Warranty Terms & Conditions

                                          NEW AGRICULTURAL EQUIPMENT WARRANTY

Zetor North America (the “Warrantor”) warrants to the retail purchaser from an authorized Zetor dealer, or the subsequent owner (the “Purchaser”), that the equipment is free from defects in material and workmanship. The warranty period is set forth below and is determined from the date of delivery to the Purchaser.

If within the warranty period the Purchaser discovers a defect in the equipment for which warranty service is required, the Purchaser shall arrange for the equipment to be inspected at one of Warrantor’s authorized dealers and shall be responsible for pickup and delivery of the equipment, including the cost therefore. When possible, Purchaser should have warranty work done by the selling dealer. Any parts be proven defective in material or workmanship shall be repaired or replaced, at Warrantor’s option. That is the extent of Warrantor’s liability under this warranty and upon the expiration of the applicable warranty period, all such liability shall terminate.

The base warranty period is twenty-four (24) months from the date of delivery to the original retail purchaser or 1800 hours, whichever occurs first. Excluded is battery, which is warranted for a period of twelve (12) months.

Tractor powertrain warranty is sixty (60) months from the date of delivery to the original retail purchaser or 3000 hours, whichever occurs first. Tractor powertrain is limited to engine crankcase, clutch housing, gearbox housing, differential housing, rear axle housing and front axle housings and all parts fully encased within.

The warranty period is twenty-four (24) months from the delivery to the original retail purchaser.

The warranty period is twelve (36) months from the delivery to the original retail purchaser.

Parts used in warranty repairs shall be covered for 360 days, or the balance of warranty period, whichever is longer.

The warrantor does not cover normal wear and tear. In addition, the warrantor does not cover normal maintenance items which include, but are not limited to filters, belts, lubricants, light bulbs, antifreeze, repainting or touch-up etc., unless contaminated or damaged by failure of warranted part. In addition, Warrantor will not be liable for damages due to unauthorized modifications or alterations, improper use, improper maintenance, including noncompliance with mandatory maintenance schedule in the operator’s manual, improper fuel or oil or lack of oil or water, accident, misuse, neglecting first symptoms of defect, improper storage, or if the equipment is used for a purpose for which it is not designed (including installation of attachments not previously authorized by the Warrantor), or if the equipment was rented to others. Refer to operator’s manual for proper use, maintenance and installation.

To qualify for warranty, a defect must be repaired using only original equipment parts supplied by Zetor North America, Inc.

Except as set forth herein, the dealer has no authority to make any additional representations or commitments on behalf of Warrantor, or to modify in any way the terms or limitations of this warranty. The warranty gives you specific legal rights, and you may also have other rights, which vary from state to state. EXCEPT AS EXPRESSLY STATED IN THIS WARRANTY, THE WARRANTOR SHALL NOT BE LIABLE FOR DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR OTHER TYPE OF DAMAGES ARISING OUT OF OR RESULTING FROM USE OF THE EQUIPMENT. THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTIBILITY OR FITNESS FOR A PARTICULAR PURPOSE. Some states do not allow the exclusion or limitation of incidental or consequential damages or allow limitations on the duration of an implied warranty, so the above exclusions or limitations may not apply to you. The Warrantor does not authorize any person to modify or extend the terms of this Warranty or to create for it any other obligation or liability in connection with the equipment.

The Warrantor warrants to the initial purchaser and each subsequent owner, that engine used in this equipment (herein engine) is designed, built and equipped to conform at the time of initial sale to all applicable regulations of the U.S. Environmental Protection Agency (EPA), and that the engine is free of defects in materials and workmanship that would cause this engine to fail to conform with EPA regulations during its warranty period. For the parts listed under PARTS COVERED, the dealer or service center authorized by Zetor will, at no cost to you, make the necessary diagnosis, repair or replacement necessary to ensure that the engine complies with applicable U.S. EPA regulations.

The warranty period for this engine begins on the date of sale of the new engine to the ultimate retail purchaser and continues for a period of 3000 hours or five years, whichever first occurs.

OWNER'S WARRANTY RESPONSIBILITIES

As the engine owner, you are responsible for the performance of the required maintenance listed in your owner's manual. Zetor recommends that you retain all receipts covering maintenance on your engine, but Zetor cannot deny a warranty claim solely for the lack of receipts or for your failure to ensure the performance of all scheduled maintenance. As the engine owner, you should however be aware that Zetor may deny your warranty coverage if your engine or a part has failed due to abuse, neglect, improper maintenance or unapproved modifications. You are responsible for presenting your engine to the nearest dealer or service center authorized by Zetor when a problem exists. If you have any questions regarding your warranty rights and responsibilities, you should contact Zetor for the information.

PARTS COVERED

Listed below are the parts covered by the Federal Emission Design and Defect Warranty. Some parts listed below may require scheduled maintenance and are warranted up to the first scheduled replacement point for that part.

The warranted parts include: Turbocharger;  Charge air cooler or intercooler;  Injectors;  Fuel injection pump;  Glow plugs.

The Federal Emission Design and Defect Warranty shall not cover any of the following:

(a) Conditions resulting from tampering, misuse, improper adjustment (unless they were made by the dealer or service center authorized by Zetor during a warranty repair), alteration, accident, failure to use the recommended fuel and oil, or not performing required maintenance services,

(b) The replacement parts used for required maintenance services,

(c) Consequential damages such as loss of time, inconvenience, loss of use of the equipment etc.,

(d) Diagnosis and inspection fees that do not result in eligible warranty service being performed, and

(e) Any non-authorized replacement part, or malfunction of authorized parts due to use of non authorized parts

You are responsible for the proper use and maintenance of the engine. You should keep all receipts and maintenance records covering the performance of regular maintenance in the event questions arise. These receipts and maintenance records should be transferred to each subsequent owner of the engine. Zetor reserves the right to deny warranty coverage if the owner has not properly maintained the engine. Zetor will not deny warranty repairs, however, solely because of the lack of repair maintenance or failure to keep maintenance records. MAINTENANCE, REPLACEMENT OR REPAIR OF EMISSION CONTROL DEVICES MAY BE PERFORMED BY ANY REPAIR ESTABLISHMENT OR INDIVIDUAL; HOWEVER, WARRANTY REPAIRS MUST BE PERFORMED BY A DEALER OR SERVICE CENTER AUTHORIZED BY ZETOR. THE USE OF PARTS THAT ARE NOT EQUIVALENT IN PERFORMANCE AND DURABILITY TO AUTHORIZED PARTS MAY IMPAIR THE EFFECTIVENESS OF THE EMISSION CONTROL SYSTEM AND MAY HAVE A BEARING ON THE OUTCOME OF A WARRANTY CLAIM. If other than the parts authorized by Zetor are used for maintenance replacements or for the repair of components affecting emission control, you should assure yourself that such parts are warranted by their manufacturer to be equivalent to the parts authorized by Zetor in their performance and durability.

                                                                                                                                                                            OBTAINING WARRANTY SERVICE

To obtain Warranty service, take your equipment to the nearest Authorized Zetor Distributor or Dealer. Bring your sales receipts showing the date of purchase for this equipment. All parts and accessories replaced under this warranty become the property of Zetor.

HOW TO MAKE A CLAIM

All repairs qualifying under this limited warranty must be performed by a dealer or service center authorized by Zetor.
